MBBS course is not higher education

The Karnataka High Court was on Friday told that the MBBS course was not higher education and that it was not governed by a Central Act.

The court was hearing appeals by the State Government, the Common Entrance Test (CET) Cell and students against a single judge order setting aside the admission of 237 first year medical students, saying that they had not met the Medical Council of India (MCI) guidelines.

Counsel for students said in MBBS it was the State rules that mattered.

He said the students were not impleaded before the single-judge and nor had a single student been heard by the judge.

He said 211 of the 237 students belonged to the reserved category and if their admissions were set aside, it would violate social justice apart from their constitutional rights.

A Division Bench comprising Justice B. Padmaraj and Justice V. Jagannatahan, which is hearing the appeals, adjourned further hearing on the matter.
