Give Class XI Students Subjects Of Choice: HC

In a ruling which will have a bearing on class XI admissions, the Delhi High Court has held that a school should accommodate their own students in a stream of the latters choice if seats are available.

A school is not an industry; it exists for its students and is responsible for his or her academic achievement. They exist for education and not results, held the court.

Justice Vikramjit Sen said since admission to class XI was not re-admission, the school could not compel the student to leave the school by denying a subject of his or her choice. Since a school was responsible in large measure for his or academic achievement, they must take pride in improving results of a weak student.

Directing Delhi Public School, Mathura Road to admit a student to science stream who scored 65.2% in his board examinations, Justice Sen said the school must give priority to him rather than exulting in the extraordinary marks of students who had proved their brilliance in other institutions.

N Singh had joined DPS, Mathura Road in 1993 and secured 60% marks in science and mathematics. He applied for admission in the science stream. The school principal, however, offered him commerce stream without maths stating that stream selection in class eleven was done purely on merit basis.

Before the court, the boys advocate took shelter under a Supreme Court judgment wherein a student was allowed to study in the school which had denied her admission as she had scored less than 50% marks. The school had, in that case, issued a circular asking parents to withdraw their children.

DPS, Mathura Road however, argued that they had not denied admission to the boy. According to the school, the head of the institution had the right, under the Delhi School Education Act, to regulate admissions on the basis of result in a particular class or school.

Allowing the boys writ petition, Justice Sen said since Supreme Court had envisaged that once a student is admitted to a school, his admission continues until he passes the last examination. The examination of class X cannot be regarded as the terminal examination for those who want to continue their studies in the class XI, said Justice Sen
